Statement of Privacy & Terms of Use

National Association of City Transportation Officials (NACTO) Statement of Privacy and Terms of Use

NACTO is committed to protecting your privacy. This Statement of Privacy applies to NACTO Web site and governs data collection and usage at all NACTO sites and services; it does not apply to other online or offline sites, products or services. Please read the NACTO Statement of Privacy. NACTO is a general audience web site, intended for users of all ages. Personal information of all users is collected, used and disclosed as described in this Statement of Privacy.

Collection of your Personal Information

NACTO may collect personal information, such as your e-mail address, name, home or work address or telephone number. Information collected by NACTO is used solely for the purpose of conference billing and delivering newsletter explicitly requested by you.

We obtain personal information from you when you provide it directly to us, for examples – when you engage with our staff, fill out a form, sign up for our conference, or are designated as a contact in your member city. We also obtain information about you indirectly when you visit our website, including technical information about your device and browsing such as your IP address and your interactions with our website. We also track browser behavior using cookies.

Use of your Personal Information

NACTO and its operational service partners collect and use your personal information to process event orders and deliver requested newsletters. It is possible that NACTO may also use personal information to inform you of recent news from NACTO and its affiliates. NACTO may also contact you via surveys to conduct research about your opinion of transportation issues.

NACTO does not sell, rent or lease its customer lists to third parties. NACTO may, from time to time, contact you on behalf of external partner organizations about a particular offering that may be of interest to you. In those cases, your personal information (e-mail, name, address, telephone number) may be transferred temporarily to, and used once by, the third party. An example of this use may be to invite you to a third-party-run networking event run as an ancillary event to one of our own (i.e. at NACTO’s annual conference).

We occasionally hire other companies and organizations to provide limited services on our behalf, such as handling the processing and delivery of event tickets, providing customer support, processing transactions, or performing statistical analysis of our services. We will only provide those companies the personal information they need to deliver the service. They are required to maintain the confidentiality of your information and are prohibited from using that information for any other purpose.

NACTO does not use or disclose sensitive personal information, such as race, religion, or political affiliations, without your explicit consent.

NACTO may access and/or disclose your personal information if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on NACTO or the site; (b) protect and defend the rights or property of NACTO, including its Web site; or (c) act under exigent circumstances to protect the personal safety of users of NACTO or the public.

Personal information collected on this site may be stored and processed in the United States or any other country in which NACTO or its affiliates, subsidiaries or agents maintain facilities, and by using this site, you consent to any such transfer of information outside of your country. NACTO abides by the safe harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of data from the European Union. NACTO is also compliant with the European Union’s General Data Protection Regulation (GDPR) where it applies to our activities.

Your Privacy Rights and Choices

NACTO offers its customers choices for the collection, use and sharing of personal information. You may notify us of your preferences by emailing [email protected]. Please be sure to provide complete account information so we can identify you in our records.

You may also stop the delivery of future e-mail from NACTO by responding directly to any email you receive with a request to remove you from the mailing list.

In accordance with GDPR, you have the following rights:

  • To request from us access to (including a copy of) your personal information.
  • To ask us to update your personal information if it is inaccurate (and you can ask us to check if you are unsure)
  • To ask us to delete your personal information in some cases
  • To ask us to restrict processing, if there is disagreement about its accuracy or legitimate usage
  • To object to processing where we are (i) relying on the basis of legitimate interests, or (ii) using your personal information for direct marketing or (iii) using your personal information for statistical purposes
  • To data portability in certain circumstances – where we are processing your personal information (i) on the basis of your consent, (ii) because the processing is necessary for the performance of a contract with you or to take steps at your request prior to entering into a contract, and the processing is carried out by automated means, you may ask us to provide it to you or another service provider in a machine-readable format.

To exercise your rights, email [email protected]. Please note that these rights are subject to exemptions and may only apply in limited circumstances. We may also ask for additional information to confirm your identity and for security purposes before we are able to comply.

If your data is subject to the GDPR, you have the right to lodge a complaint to the Supervisory Authority in your country, if you believe that we have not complied with the requirements of the GDPR with regards to your personal information (in the UK, for example, this would be the Information Commissioner’s Office, or ICO – www.ico.org.uk/global/contact-us ).

Retention of personal information

In general terms, we will retain your information for as long as necessary to fulfil the purposes for which it was collected and/ or it is used. However, if before that date (i) your personal information is no longer required in connection with such purpose(s), (ii) we are no longer lawfully entitled to process it or (iii) you validly exercise your right of deletion, we will remove it from our records at the relevant time.

Where required, in some cases we will keep personal information at least as long as necessary to comply with relevant regulatory or statutory requirements. We will also retain information, when and as long as necessary, to resolve legal disputes.

Security of your Personal Information

NACTO is committed to protecting the security of your personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. For example, we store the personal information you provide on computer systems with limited access that are located in controlled facilities. When we transmit highly confidential information (such as a credit card number) over the Internet, we use a secure, external, payment gateway so your information is protected.

Changes to this Statement

NACTO will occasionally update this Statement of Privacy to reflect company and customer feedback. If there are material changes to this Statement or in how NACTO will use your personal information, NACTO will prominently post or email a notice of such changes prior to implementing the change. NACTO encourages you to periodically review this Statement to be informed of how NACTO is protecting your information.
